Anti-social Behaviour (ASB) privacy notice

If you contact Westminster City Council regarding an anti-social behaviour complaint, incident, enquiry, or case review, you must be aware of this privacy notice.
A privacy notice is a statement issued by an organisation which explains how personal and confidential data about individuals is collected, used, and shared.
Purpose for processing your information
We collect personal data relating to witnesses, victims, alleged perpetrators of crime and anti-social behaviour. We also collect data on vulnerable individuals. Information gathering is necessary for the service to perform a task in the public interest and to undertake its official functions.
Who is collecting and using your personal data?
Westminster City Council will act as the data controller for any personal information you provide to us.
Your personal data refers to any information that can be used to identify a living person.
How the law allows us to use your information
These functions have a clear basis in law under Article 6 GDPR 2018, the Anti-Social Behaviour Crime and Policing Act 2014, the Housing Act 1985, the Housing Act 1996, and the Prevention of Social Housing Fraud Act 2013.
Who the information is shared with
We may share your information with other services and ask other agencies for information about you only if it is appropriate and relevant. Under the Crime and Disorder Act 1998, Section 115, we can share information with the police to prevent crime and disorder without your consent.
This information will include but not limited to:
- other departments within the council
- Metropolitan Police Service
- British Transport Police
- London Fire Brigade
- health services
- National Prison and Probation Service
- Transport for London
- support agencies
- registered housing providers
How do we protect your information?
We will maintain the reliability, accuracy, completeness, and currency of personal data in our databases and protect the privacy and security of our databases.
Our servers and databases are protected by industry-standard security technology.
Employees with access to personal data have been trained to handle such data correctly and per the latest regulations.
How long do we keep your personal information?
We keep your personal data only for as long as reasonably necessary for the purposes for which it was collected.
Your rights and access to your information
You have various rights around the data we hold about you:
- right of access (to receive a copy of your data)
- right to rectification (to request data is corrected inaccurate)
- right to restrict processing (to request we don’t use your data in a certain way)
- right to data portability (in some cases, you can ask to receive a copy of your data in a commonly used electronic format so that it can be given to someone else)
- right to object (generally to make a complaint about any aspect of our use of your data)
- Right to have explained if there will be any automated decision-making, including profiling, based on your data and for the logic behind this to be presented to you.
Any such request can be submitted to the Freedom of Information (FOI) Team. Whether we can agree to your request depends on the specific circumstances, and if we cannot, we will explain why.
If you have any concerns
If you are unhappy with any aspect of how your information has been collected and/or used, you can complain to the Freedom of Information (FOI) Team. You can also report concerns to the national regulator, the Information Commissioner’s Office (ICO), by visiting the ICO website.

If you do not provide any personal data
If you make an anonymous complaint about anti-social behaviour, Westminster City Council will review your complaint and take any appropriate action based on the information provided, but we will be unable to share any updates with you.
