Removal or variation of conditions

You can  apply to vary a condition or to remove it all together, under Section 73 of the Act.

You can use this to apply for a Minor Material Amendment to an approved scheme under Section 96A of the Act, by applying to vary the ‘approved plans’ condition (which is usually Condition 1 of the permission).

Please clearly outline the proposed changes to the approved scheme by providing a numbered list of changes accompanied by a list of the titles of all superseded and replacement drawings and supporting documents. The plans should be annotated to highlight the proposed changes and each amended supporting document should include a brief summary of the changes to that document.
