Contaminated land enquiries
The Council is often asked by purchasers of property if there is any contaminated land under specific sites in Westminster. In Westminster there are no Special Sites registered under the Environmental Protection Act 1990 78R-T, and none where notices have been served under Part IIA Section 78.Possible sources of information are:
We have formulated a standard report that answers a typical range of questions that are often asked of us. There is a charge for this service of £75 per property enquiry in order to cover the staff time involved in processing these enquiries.The information we can produce is listed below.
1) Known sites of ‘statutory’ contaminated land on or adjoining the property. In Westminster there are no sites registered under Section 143, EPA 1990 and none where notices have been served under Section 78.
2) Known processes or incidents of contaminative potential on the site or adjoining properties. This information is from a search of the Ordnance Survey historical maps. The actual maps are copied and sent with the report.
3) Location of landfill sites. There are no recent domestic refuse landfill sites, sludge disposal or diseased animal burial sites that we are aware of in Westminster. Our information has been obtained from the Environment Agency.
4) Location of any nearby private water supplies. These are all boreholes and are also licensed as groundwater abstractions by the Environment Agency.
5) Location of Part B processes controlled under Environmental Protection Act 1990 (mainly petrol stations). In Westminster there are no Part A processes.
