The introduction of the Policing and Crime Act 2009 has conferred power to the Secretary of State to specify further mandatory licensing conditions relating premises that sell or supply alcohol on the premises. The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010 was made on the 16th March 2010. This new Order sets out five additional Mandatory Conditions for premises licences and club premises certificates that sell or supply alcohol for consumption on the premises. These conditions will apply to all existing and new premises licences and club premises certificates issued by the Licensing Authority.
Mandatory Licensing Conditions 1 to 3 of this Order came into effect on the 6th April 2010. All licensed premises will, from that date have to comply with these new conditions. The remaining conditions will come into effect on the 1st October 2010.
