Planning Obligation Supplementary Planning Guidance Feb 06The City Council has adopted the Supplementary Planning Guidance (SPG) on Section 106 Planning Obligations for development control purposes with effect from 1st January 2008.

The adoption of the SPG followed a ten week public consultation period (February – April 2006) and more detailed subsequent consultations with Westminster Property Owner’s Association (WPOA) particularly in respect of the public realm formula during the course of 2006 – 2007.

Planning Obligations Model Wordings have also been published to help applicants to see the likely nature of any Planning Obligation that may be required to cover the more common situations that may arise.

The SPG had been updated to reflect the provisions of the London Plan and the Council’s emerging Local Development Framework (LDF). It is developed following the guidance set out in Circular 05/05 and relevant best practice documents.  It now includes standard clauses, formulae and charges to help calculate planning contributions, and the provision to pool contributions to address the cumulative impact of multiple developments.  The public realm formula introduced in this SPG is the result of the consultation with WPOA.

The Planning Bill introduced on 27th November introduces proposals for a new Community Infrastructure Levy which will impact on S106 Planning Obligations when the levy becomes effective.  In the interim the City Council will keep the SPG and its implementation under review as part of the Annual Monitoring Report (AMR) and Local Development Framework (LDF) process.
