This form is for reporting a racist incident related to Westminster City Council services only. If you use this form to report a racist incident relating to a non-Council related service, we will contact you (provided you have given us your details in Part B) and advise you who can best deal with your incident.
A racist incident is ANY incident, which is perceived to be racist by the victim or ANY OTHER PERSON. An incident can still be a racist incident even though no crime has been committed. No judgment will be made as to whether or not the incident is a racist incident when it is first reported. The objective is to ensure that any investigation can take full account of the possibility that there is a racist dimension to the incident.
A racist incident MAY also amount to a criminal offence, which will be investigated by the police. However, as mentioned above, not all racist incidents will be criminal in nature. If you think that a racist incident amounts to a criminal offence, you should contact your local police station. Alternatively, you can contact the Council’s Community Protection Department on 020 7641 2082. In cases of emergency, you should always telephone 999. If you are unsure as to whether the incident amounts to a crime, you should complete this form where it relates to a Council service. Subject to you providing contact details, the Council will then be able to provide further advice to you.
Any personal information that you provide on this form will be treated confidentially. We will NOT give personal details about you to anyone, including the police or other organisations without your consent. However, you are encouraged to give consent for the disclosure of personal information as that will make any investigation into the incident that much easier and quicker. That is to your advantage and the advantage of other victims and potential victims. You can also choose to disclose information to some agencies, but not to others.
We will not usually give any other information (i.e. non-personal information) to other organisations without your consent, though there may be exceptional circumstances where details of the incident itself do have to be provided. Where we receive a report of a racist incident, which is particularly serious, we may conclude that it would be irresponsible not to share the data with other agencies, including the police, even though you have not given your consent. Before doing that, we will take account not only of the seriousness of the incident, but also of the danger of recurrence. We will also have regard to any danger to you and any other witnesses or victims. You will be notified in advance in the unlikely event that any information is to be disclosed without your consent.
