Who is Responsible

If you are a City Council Tenant / Lessee

CityWest Homes Ltd is responsible for managing the risks associated with asbestos containing material (ACMs) within residential buildings (including common parts) owned by the City Council. They also have certain ‘Landlord’ responsibilities to lessees.

If you are an Owner/Occupier

As an owner/occupier you will not have any statutory responsibilities for managing the risk associated with ACMs that may be found in your property. However you will want to know where any ACMs are located to enable you to protect yourself and your family. You will also have a duty of care to any contractors you might employ to help you maintain your property (for example: decorators, plumbers and electricians.)

If you live in a privately owned block of flats or apartments your landlord or his managing agent will have a statutory responsibility to identify and manage ACMs within the common parts. (This will include common services such as insulated heating pipes that may pass through your property.)

If you have Management responsibility for non-domestic premises

If you have management responsibility for non-domestic premises that may contain ACMs you have a statutory duty to manage the risk from these materials. As indicated above the term non-domestic premises includes the common parts of residential accommodation comprising self-contained flats.
