Under the City of Westminster Act 1999, it is an offence for a person who is not the holder of a street trading licence, or a temporary licence, to engage in street trading. The placing of tables and chairs for customers’ use on the highway constitutes “supplying or offering to supply a service for gain or reward in the street”, even if the food and drink are not served directly at the tables.
